These Terms of Use (“Terms”) govern access to and use of the BloomDue website at bloomdue.baby, related BloomDue web tools we operate, and the BloomDue private beta mobile application (together, the “Service”). “BloomDue”, “we”, “us” refers to the company above.
§ 02
Acceptance of terms
By accessing or using the Service you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.
If you use BloomDue on behalf of a family or household, you represent that you have authority to share the information you enter and to invite other carers where applicable.
§ 03
Service description
BloomDue is a calm care-logging and educational product for parents and carers. It may include features such as logging feeds, sleep, diapers, growth, pregnancy moments, partner sync, and educational guidance.
Descriptions on the website are informational. Features available during private beta may change, be limited by invite, or differ by platform.
§ 04
Educational information — not medical advice
BloomDue provides general educational information and organisational tools. It does not provide medical advice, diagnosis, prescription, triage, or emergency services, and it does not replace consultation with a qualified healthcare professional.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. If you think you or your child may be experiencing a medical emergency, call your local emergency number immediately.
§ 05
Private beta access
During private beta the Service is provided free of charge for testing and early use. Beta access may be limited, revoked, or modified at any time. The Service may contain bugs, incomplete features, or temporary downtime.
We may ask for feedback. Feedback is voluntary; you grant us a non-exclusive right to use it to improve BloomDue without obligation to compensate you, unless we agree otherwise in writing.
§ 06
Accounts and security
Some features require an account (for example email magic-code sign-in). You agree to provide accurate contact details, keep sign-in codes confidential, and notify us promptly if you suspect unauthorised access.
You are responsible for activity under your account, including data you enter and carers you invite. You must be old enough under applicable law to enter these Terms (and in any case not a child using the app as the primary account holder).
§ 07
Acceptable use
You agree to use the Service lawfully and in good faith, and not to:
- attempt to compromise security, integrity, or availability of the Service;
- probe, scan, or reverse engineer the Service except as allowed by law;
- upload unlawful, harmful, misleading, or infringing content;
- use the Service to harm others or for fraudulent purposes;
- misrepresent BloomDue as a clinical or emergency service;
- resell or commercially exploit the private beta without our written consent.
§ 08
Your content and family data
You retain rights in the care logs, notes, profiles, and other content you submit (“Your Content”). You grant us a limited licence to host, process, back up, and display Your Content solely to operate and improve the Service for you and the carers you invite.
You are responsible for the accuracy of information you enter about children or other family members and for having a lawful basis to share it with co-carers.
§ 09
Intellectual property
The Service and its content (including branding, design, text, graphics, and software), excluding Your Content, belong to Globinary or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or distribute them without our written consent, except for normal use of the Service.
§ 10
Availability and changes
We may update, suspend, or discontinue parts of the Service, including during private beta. We may also update these Terms. The applicable version is the one published on this page at the moment of access. Continued use after a material update constitutes acceptance of the revised Terms, except where applicable law requires otherwise.
§ 11
Limitation of liability
The Service is provided “as is” and “as available”, especially during private beta. To the fullest extent permitted by law, Globinary is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from use of or inability to use the Service.
Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence where such exclusion is prohibited, or for fraud.
You remain solely responsible for healthcare decisions. BloomDue is not a substitute for professional care.
§ 12
Third-party services and links
The Service may link to external sites or rely on infrastructure and tools provided by third parties (for example hosting or analytics). We do not control and are not responsible for third-party content, availability, or privacy practices, except as required for our own processors as described in the Privacy Policy.
§ 13
Privacy
Processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.
§ 14
Governing law and disputes
These Terms are governed by Romanian law. Any disputes are resolved amicably where possible and, failing that, by the competent courts at Globinary’s registered office (Baia Mare, Maramureș County, Romania), without prejudice to mandatory consumer protections that may apply in your country of residence in the EU/EEA.
